One mine worker in Kentucky is now fighting his termination, saying he is being punished for what’s referred to as “whistleblowing.” The worker reported working conditions to the Mine Safety and Health Administration (the equivalent of OSHA to the construction field). He was then fired.
The worker claims he was fired for complaining. His employer says it was another matter entirely.
His complaints involved working in confined space and his refusal to work on machinery that had not been de-energized—both of which are valid safety issues. The MSHA is now looking into the reasons for his termination.
You shouldn’t have to work in unsafe conditions. The law says so. You have rights even when you work in an inherently dangerous field.
